Federal Employees Refusing The Phony Injections In This COVID-19 Hyped Atmosphere

Here are my thoughts in no particular order:

  1. What is your current job worth to you and your pension and TSP and healthcare and I know, as to the latter, some of you would have tricare and VA, potentially?
  2. As to legal fees and costs, my firm starts with a relatively low retainer and assesses the issues to determine if there are similarly situated plaintiffs whose litigation you could join or whether you need to go into federal court yourself (yes, very expensive) and I do not typically handle such matters, particularly in Alabama where I am not yet waived in to the State Bar or local federal District Court.
  3. As it is a federal agency, I am admitted into the NJ State Bar, and I can represent you and the first order of business for you would be Merit Service Protections Board should your federal agency initiate an adverse job action against you
  4. If you surrender, you get nothing
  5. If you litigate the matter, it is expensive and you can appeal the outcome if it is unfavorable (neither 4 nor 5 are great options)
  6. Should your matter proceed to a contested case before an administrative law judge at MSPB, we are talking fees and costs in the neighborhood of $10,000.00 and possibly more, between research, writing in this novel area of government tyranny of its own, hard-working, law-abiding and productive employees
  7. The trial triggers its own expenses with possible expert witness(es) and the cost of offering evidence and testimony from your witness(es) and cross-examining government witnesses.

I am attaching a pair of quotes which resonated with me from books that I read on Dietrich BonHoeffer and another from the great DeToqueville in the last few years. You can infer where I stand and I will add that my wife and I hired counsel back in NJ when her rehabilitation facility terminated her medical privileges and access to patients in denying a religious accommodation or medical exemption.

Eerie times that require audacity and principle, and principle costs money, as you correctly feared.

DeToqueville:  Unlimited power is in itself a bad and dangerous thing. Human beings are not competent to exercise it with discretion. God alone can be omnipotent, because his wisdom and his justice are always equal to his power. There is no power on earth so worthy of honor in itself or clothed with rights so sacred that I would admit its uncontrolled and all-predominant authority. When I see that the right and the means of absolute command are conferred on any power whatever, be it called a people or a king, an aristocracy or a democracy, a monarchy or a republic, I say there is the germ of tyranny, and I seek to live elsewhere, under other laws.

I do not say that there is a frequent use of tyranny in America at the present day; but I maintain that there is no sure barrier against it, and that the causes which mitigate the government there are to be found in the circumstances and the manners of the country more than in its laws.
