How do health professional licensing complaints work?

When a health care provider or consumer/patient makes a complaint alleging professional misconduct, incompetence, negligence or impairment on the part of a health professional, the matter is referred to the Medical Practitioner Review Panel. This panel investigates the complaint and then makes a recommendation to the Board of Medical Examiners based on its findings. The Panel’s recommendation to the Board may be to:

  • Investigate further
  • Close the investigation
  • Initiate disciplinary proceedings, including suspending or revoking the professional’s license
  • Defer a recommendation pending the outcome of litigation or disciplinary action
  • Refer the professional to focused education or treatment

The Panel may also recommend the immediate temporary suspension of the professional if the panel believes the professional poses an imminent danger to patients.

The State Board of Medical Examiners can affirm, reject or modify the panel’s disposition of the complaint. You are entitled to counsel at every stage of these proceedings, including before the Medical Practitioner Review Panel and the State Board of Medical Examiners.
